서비스 이용약관

serversim (https://serversim.io, “Company”) operates an architecture simulation service (the “Service”). These Terms summarize — in English — the rights and obligations between the Company and you.

Article 1 (Purpose)

These Terms govern the use of the Service, including conditions and procedures, rights and responsibilities, and any other necessary matters.

Article 2 (Definitions)

• Service: all features provided at serversim.io — simulator, docs, blog, benchmarks, templates, documents management, etc.
• User: any visitor (member or non-member) who agrees to these Terms.
• Member: a user who has signed up via Google OAuth and holds an account issued by the Company.
• Free Plan: features offered at no cost (simulator, 74 scenarios, 33 logical services, up to 5 saved documents, etc.).
• Pro Plan: paid monthly subscription (currently $9/month, subject to change) — unlimited AI Review, cloud cost estimation, unlimited scenario storage, priority support.
• Document: a single scenario plus its metadata, owned by a user.

Article 3 (Effect & changes)

1. These Terms take effect for as long as the Service is operated.
2. The Company may amend these Terms within applicable law. Material changes are posted 7 days in advance (30 days if the change is adverse to users).
3. If you continue to use the Service after the effective date without objection, you are deemed to have agreed.

Article 4 (Account & eligibility)

1. Registration is via Google OAuth (no separate password).
2. By signing up, you accept these Terms and the Privacy Policy.
3. Users under the age of 14 may not register.
4. The Company may decline or terminate accounts that misuse another’s email, provide false information, were previously terminated for ToS violation, or violate applicable law / public order.

Article 5 (Provision of Service)

1. The Service is provided 24/7 in principle.
2. Scheduled maintenance is announced in advance.
3. Force-majeure events (natural disasters, DDoS, infrastructure outages) may interrupt the Service; the Company will take reasonable mitigation.
4. Features may be added, changed, or discontinued. Important changes are announced in advance.

Article 6 (Paid Service)

1. Pro Plan is billed monthly via our Merchant of Record (Lemonsqueezy). We do not store your card details directly.
2. Existing subscribers keep their current price for 30 days after a price change.
3. Cancellation is one-click via the billing partner’s customer portal. Renewal stops immediately; access continues until the end of the paid period.
4. Refunds follow the Refund Policy (30 days, no-questions-asked).
5. VAT is handled automatically by the Merchant of Record.

Article 7 (Your obligations)

1. You agree not to:
   • Use another user’s account or share credentials
   • Reverse-engineer, scrape, or abuse automation against the Service
   • Disrupt normal operation (excessive requests, exploiting security flaws, etc.)
   • Abuse AI Review with automated bots
   • Upload content violating law or public order (obscene, violent, infringing IP, etc.)
   • Infringe the Company’s or third parties’ intellectual property
2. You are liable for damages caused by your violations.

Article 8 (Intellectual Property)

1. All content on the Service (scenarios, benchmark data, UI design, docs, code) is copyrighted by the Company.
2. Documents you create are yours; you grant the Company a non-exclusive, worldwide, royalty-free license to operate the Service.
3. Non-commercial use of screenshots for teaching, education, or blog posts is permitted with attribution.
4. Open-source dependencies (React, Next.js, PixiJS, zustand, Supabase, etc.) follow their respective licenses.

Article 9 (Limitations of liability)

1. The Service is an educational / learning / architecture-discussion tool.
2. Simulator results are validated against public benchmarks (TechEmpower, sysbench, YCSB, etc.) with mean absolute error ~3.1%, but absolute accuracy is not guaranteed.
3. Do not use the simulator as the sole basis for production decisions. Pair with real load testing.
4. The Company is not liable for any direct or indirect damages arising from decisions made using the Service.
5. The Company is not liable for outages caused by force majeure or third-party services (Supabase, Vercel, Anthropic, Google).

Article 10 (Suspension & termination)

1. You may withdraw membership at any time (nav user menu → account settings, or by email). Termination is immediate.
2. The Company may suspend or terminate accounts that violate these Terms or applicable law, without prior notice in urgent cases.
3. For minor violations, the Company will provide notice and 7-business-day cure period.
4. On termination, personal data is handled per the Privacy Policy.

Article 11 (Dispute resolution & jurisdiction)

1. Disputes will first be resolved through good-faith discussion.
2. If unresolved, parties may use the Korean Consumer Agency dispute mediation under Article 33 of the E-Commerce Act and Article 57 of the Framework Act on Consumers.
3. Otherwise, the competent court at the Company’s principal place of business shall be the first-instance court of jurisdiction.
4. For overseas users, these Terms are interpreted under the laws of the Republic of Korea unless otherwise agreed.

Article 12 (Special terms & other)

1. Enterprise / B2B: a separate agreement supersedes these Terms. Contact pajamasi726@gmail.com.
2. API use: separate terms apply when public APIs are offered.
3. Matters not specified herein are governed by Korean law (Act on Regulation of Standard Terms, E-Commerce Act, Information & Communications Network Act, Personal Information Protection Act, Copyright Act, etc.).
